HUMAN RESOURCES

All employers are required by law to post this U.S. Department of Labor (DOL) notice for their employees. It informs employees of their rights under the Families First Coronavirus Response Act (FFCRA). The DOL has a “Questions and Answers” page that may assist doctors in understanding their legal obligations under FFCRA.

The National Federation of Independent Business (NFIB) has a summary of the legislation’s requirements.

Texas Lawyer has posted a helpful article explaining the FFCRA at its web site.

Mintz (a law firm) published an article entitled Answers to Lingering FAQs Regarding the Families First Coronavirus Response Act, which provides helpful guidance for employers seeking to understand these new employment laws.

Certain health care providers, including chiropractors, may be excluded from the emergency family leave and emergency paid sick leave in the FFCRA. Dorsey & Whitney LLP has published a thorough explanation of this exemption.

Small businesses with fewer than 50 employees may qualify for exemption from the requirement to provide leave due to school closings or childcare unavailability if the leave requirements would jeopardize the viability of the business as a going concern. As Holland & Knight explains, employers wishing to seek the exemption should document why their business meets such criteria
